How Does Selling a House During Divorce Work in California?

A direct answer

In California, once a divorce petition is filed, automatic temporary restraining orders (ATROs) freeze the family home: neither spouse can sell, transfer, or refinance it without the other's written consent or a court order. The home is community property, so net proceeds are generally divided equally after the mortgage, closing costs, and commissions are paid.

First, agreement is the default

Before any trial, the home can usually be sold only if both spouses agree in writing. When both agree, they choose the agent and listing price together and split the net proceeds. An agreed sale is faster, cheaper, and far less stressful than a court fight.

When a court order is needed

If one spouse refuses to cooperate, the other can ask the family court to order the sale. Courts typically grant these requests when the mortgage is in default or foreclosure looms, when one spouse faces hardship, or when the property cannot be divided fairly any other way. A court-ordered sale works, but it is slower and costlier.

The alternatives to selling

One spouse can buy out the other's share, or the couple can arrange a deferred sale so children can stay in the same school, with proceeds divided later. Both options need careful agreement on value and terms.

Why the agent matters

A divorce sale needs an agent who communicates clearly, keeps both parties updated, and stays neutral and professional under pressure. Hector Aguilar holds a Real Estate Collaboration Specialist-Divorce certification and has guided couples through these sales with patience and clarity.

A note on professionals

Divorce involves legal and tax decisions beyond the sale itself. Work with your attorney and tax advisor alongside your Realtor, so the property decision fits your whole settlement.
